Terms
Effective date: Wednesday 11th of June, 2025
These Terms and Conditions ("Terms") govern your use of The Next Race ("App"), developed by The Next Race ApS ("Provider"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.
Definitions
"User" refers to any person who downloads, installs, or uses the App.
"Content" refers to any text, images, video, audio, or other media available through the App.
License
Subject to your compliance with these Terms, the Provider grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial purposes. If you wish to use the App for commercial purposes, reach out to us directly via e-mail: contact@thenextrace.app before engaging in any commercial activities.
User Conduct
You agree not to:
- Use the App for any unlawful or fraudulent purposes
- Copy, modify, adapt, or create derivative works of the App or its Content
- Interfere with, disrupt, or overload the App or its underlying infrastructure
- Attempt to gain unauthorized access to the App or any associated systems or networks
Intellectual Property Rights
All rights, title, and interest in and to the App, including its Content and any associated intellectual property rights, are the exclusive property of the Provider and its licensors. You may not reproduce, distribute, or create derivative works of the App or its Content without the express written permission of the Provider.
Disclaimer
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE PROVIDER DOES NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE PROVIDER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Third-Party Services
The App allows you to connect third-party services, including but not limited to Strava, Garmin Connect, and Apple, to enhance your experience. By connecting a third-party service, you authorize The Next Race to access, send, and receive data on your behalf in accordance with the permissions you grant during that service's authorization flow.
Your use of any third-party service is also subject to that service's own terms of service and privacy policy. The Provider does not control and is not responsible for the operation, content, availability, or policies of third-party services, nor for any consequences of data shared with them at your direction. You may disconnect any third-party service at any time from the App's settings.
For Garmin Connect specifically: by connecting your Garmin account, you authorize The Next Race to push workouts from your training plans to your Garmin Connect workouts library, and — where you have granted the corresponding permissions and where Garmin has approved the relevant API access for The Next Race — to receive completed activities, wellness data, and historical data on your behalf. Garmin's own Terms of Use and Privacy Statement apply in addition to these Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Denmark, a member of The European Union, without regard to its conflict of laws principles.
Modifications
The Provider reserves the right to modify these Terms at any time, in its sole discretion. Your continued use of the App following any modification constitutes your acceptance of the modified Terms.
